Thirty-four states, the District of Columbia, and Puerto Rico have legalized medical cannabis. While no two state medical cannabis programs are alike, public health concerns related to advertising, packaging and labeling, pesticide use, scientific research, and the role of medical cannabis in the opioid crisis are emerging across the country. This article examines these issues, the policy approaches states are adopting to protect patients and the public, and an assessment of the underlying federal legal landscape.

Hegel introduced the Phenomenology of Mind as a work on the problem of knowledge. In the first chapter, entitled “Sense Certainty, or the This and Meaning,” he concluded that knowledge cannot consist of an immediate awareness of particulars ). The tradition discusses sense certainty in terms of this failure of immediate knowledge without, however, specifically addressing the problem of reference. Yet reference is distinct from knowledge in the sense that while there can be no knowledge of objects without reference, there (...) may be reference without knowledge. If that is the case, then the failure of immediate knowledge does not entitle us to conclude anything about the success or failure of reference. It is not surprising, then, that a few scholars have begun to examine sense certainty primarily as a thesis about reference. (shrink)

Since its inception in 2010, the Network for Public Health Law has aligned with federal, state, tribal, and local public health practitioners to assess how law can promote and protect the public’s health. In 2013, Network authors illustrated major trends in public health laws and policies emanating from an internal assessment of thousands of requests for technical assistance nationally. More recently, the Robert Wood Johnson Foundation has invited the Network and other partners to consider new ideas and strategies toward building (...) a “culture of health.” Per Figure 1, RWJF’s conception of a culture of health emphasizes key action areas essential to the promotion of health across all sectors and diverse populations. With more than 120 color photographs, Images of Kansas City provides an exquisite view of one of the country's most desirable places to live. This outstanding collection showcases the many landmarks and scenes associated with Kansas City: Country Club Plaza, with its beautiful fountains and statues; two great sports teams, the Kansas City Chiefs and Royals; buildings such as the Power & Light Building, the H. Roe Bartle Exhibition Hall, and the Nelson-Atkins Museum of Art; events at the American Royal (...) arena; and, of course, views of Kansas City's magnificent skyline. The images in this book were chosen from hundreds of photos submitted to William Mills by both professional and amateur photographers from Kansas City and the surrounding area. Because the contest had few restrictions about subject matter, the photos included demonstrate a wide sampling of photographic approaches and techniques, rendering an excellent portrayal of this vital city. In his introduction, William Mills provides important historical data on the background and development of Kansas City, touching briefly on the special people and features that have made Kansas City the thriving city that it is today. This article describes the tension that exists between the views of learning as a means of knowledge transfer and the alternative idea that it is socially situated and not separable from the activities in which it is developed. It concludes that the 'authentic practices' of particular academic domains should be employed in schools to encourage learning rather the culture of schooling itself.

Using a combination of network analysis and descriptive statistics, this study examines the extent to which six important and longstanding policy-oriented nonprofit organizations — foundations, think tanks, and policy-discussion groups — were connected via their directors with the 250 largest corporations in the United States in 1935–1936 and 2010–2011. The results demonstrate that the six nonprofit organizations included in the study were well integrated into corporate networks in both periods, and had an even greater integrative role in 2010–2011 than they (...) did in 1935–1936. This finding supports the hypothesis that policy-oriented nonprofit organizations allow the corporate community to develop proposals, and to reach consensus, on major policy issues. This hypothesis is further supported by an overview of existing studies that illustrate the success of these organizations in shaping policy outcomes on a range of issues. Based on the overall results, the longstanding claim that corporations influence government primarily or solely at the “interest-group” level can be supplemented by the conclusion that policy-oriented nonprofits support a policy-planning process that links the corporate community to government on general issues. In addition, the findings cast doubt on the claim that the corporate community has lost its capacity for policy cohesion in recent decades, due primarily to a “fracturing” caused by a decline in bank centrality. Since general policies have been created within the policy-planning process since at least the mid-1930s, the decline in bank centrality is irrelevant to the corporate community’s ability to formulate general policy proposals. A growing body of literature critical of ethics review boards has drawn attention to the processes used to determine the ethical merit of research. Citing criticism on the bureaucratic nature of ethics review processes, this literature provides a useful provocation for (re)considering how the ethics review might be enacted. Much of this criticism focuses on how ethics review boards _deliberate,_ with particular attention given to the lack of transparency and opportunities for researcher recourse that characterise ethics review processes. Centered specifically (...) on the conduct of ethics review boards convened within university settings, this paper draws on these inherent criticisms to consider the ways that ethics review boards might enact more communicative and deliberative practices. Outlining a set of principles against which ethics review boards might establish strategies for engaging with researchers and research communities, this paper draws attention to how _Deliberative communication_, _Engagement with researchers_ and the _Distribution of responsibility_ for the ethics review might be enacted in the day-to-day practice of the university human ethics review board. This paper develops these themes via a conceptual lens derived from Habermas’ (The theory of communicative action. Volume 1: Reason and the rationalization of society, 1984 ) articulation of ‘communicative action’ and Fraser’s (Social Text, 25(26), 56–80, 1990 ) consideration of ‘strong publics’ to cast consideration of the role that human ethics review boards might play in supporting university research cultures. _Deliberative communication_, _Engagement with researchers_ and the _Distribution of responsibility_ provide useful conceptual prompts for considering how ethics review boards might undertake their work. Purpose: Our aim was to determine if self-determined motivation (SDM) in elite, men’s soccer changes over time and differs as a function of age, skill-grouping, and engagement in soccer play and practice. We tested predictions from the Developmental Model of Sport Participation (DMSP) regarding relations between practice and play and SDM among both elite and non-elite samples. Methods: Elite youth soccer players in the UK (n = 31; from the Under 13/U13 yr and U15 yr age groups) completed practice history (...) and motivation questionnaires at time1 (T1) and ~2 years later (T2: now U15 yr & U17 yr). Non-elite players (n = 32; from U15 yr and U17 yr) completed the same questionnaires at T2 only. Results: For the elite groups, global SDM decreased over time for the current U17 group (from U15), but no change was seen for the current U15 group (from U13). Age group differences at T2 mirrored these data, with U17 players showing lower global SDM and higher controlled motivation than U15 elites. The non-elite players did not show age group differences, but elites scored higher for global SDM and autonomous motivation than non-elites. The recent hours accumulated in practice negatively correlated with global SDM in elite and non-elite groups, but play was unrelated to measures of motivation. Conclusions: Differences in SDM as a function of age and skill point towards the dynamic nature of these motivations over time, likely a result of proximity to external rewards related to professional status. Although high volumes of practice are related to lower global SDM in both skill groups, the absence of any relations between SDM and soccer play does not support a key prediction related to the DMSP. The most common view of Mill sees him as the classic liberal and one key element in this liberalism is said to be that his thought ‘rests on the belief that the use of reason can settle fundamental social conflicts’. He is seen by a leading authority as ‘the rationalist, confident that social change could be effected by the art of persuasion and by the simple fact that men would learn from bitter experiences’. To point out that at various (...) times in his life Mill supported the use of violence in political life is insufficient in itself to challenge this basic view. However, if it can be shown that Mill's support for political violence adds up to a coherent justificatory theory then Mill's standing as the model liberal upholder of reason might need to be revised. Or at least the commonly assumed opposition between reason and violence will need to be re-examined. Are there circumstances in which the use of violence rather than persuasion is the rational course? In looking at Mill's response to events in France, America, Ireland, and Canada as well as his attitude to British politics it is clear that there are numerous examples of his support for the use of violence: ‘I do not scruple to say that I have sympathised more or less ardently with most of the rebellions, successful and unsuccessful, which have taken place in my time’. Our present concern is to see whether he developed any general principles whereby such violence could be shown to be legitimate. (shrink)

John Stuart Mill (1806 1873) was one of Britain's greatest philosophers and radical politicians, whose views had a profound influence on thinking on liberty, social policy and gender relations. William Stafford's accessible study outlines Mill's reputation from his lifetime to the present, together with a discussion of the major areas of his moral and political thought.

The larger topic which interests me is the general influence of the Greeks on Mill but here I shall concentrate on one aspect of this larger problem – can some of the difficulties which Mill is seen as getting into with his modified utilitarianism be better understood through an appreciation of the primacy of Greek views on happiness instead of the usual emphasis given to the Benthamite starting-point? The traditional objections to Mill's version of utility hardly need (...) rehearsing: how can he admit a qualitative element into a scale which only objectively measures quantity? How can he include the higher nature of man in a scheme which only recognizes pleasures and pains? Whether these and other criticisms lead the commentator to condemn Mill's attempt or whether they act as a springboard to discover a plausible defence of Mill, there is today a consensus that Mill's trouble arises from tampering with Bentham as a result of later alien influences. This study argues that the English-born, Edinburgh-educated and Bath-based physician William Falconer (1744–1824) authored the only stadial history published during the British Enlightenment that analysed the influence of socio-economic context upon religious belief. A survey of the conjectural histories of religion written by the leading literati demonstrates that discussion of religion by the Scottish literati was undertaken separate from the “Scottish narrative” of stadial economic and political progress. We have to turn to Falconer’s Remarks on the Influence of Climate (...) (1781) to see a four-stage history of religion that related belief and practice to wider social and economic developments. While heavily derivative of Montesquieu’s De l’Esprit des Lois (1748), Falconer’s Remarks has some claim to theoretical innovation and used his conjectural history to tell a story of English (not British) religious exceptionalism. Moreover, the work was received as a serious contribution to the late Enlightenment’s science of human nature and society. (shrink)

This essay situates Mill in relation to modern utilitarianism, comparing some of his ideas with current thinking and highlighting aspects of his thought that have influenced it. Scholarly controversy over whether Mill was an act‐ or rule‐utilitarian has had a lasting influence on modern utilitarianism, prodding theorists to identify and refine various possible forms of the theory. By contrast, Mill's defense of a qualitatively‐oriented hedonism and his famous ‘proof’ of the theory have had little impact. Nevertheless, utilitarians (...) today share his skepticism about moral intuition and his belief that any acceptable moral system must have a consequentialist structure. Mill strengthened the case for utilitarianism by answering various objections to it, objections that utilitarianism's detractors continue to advance. His rejoinders to these criticisms are among his most seminal contributions to utilitarian thinking because his arguments and insights, many utilitarians believe, point toward a sophisticated, largely indirect form of utilitarianism, one that is subtle, refined, and attractive. This paper examines John Stuart Mill’s ‘psychological theory’ of the mind, as he set it out in his Examination of Sir William Hamilton’s Philosophy. After outlining Mill’s theory and the problem he finds with it, the paper discusses four different interpretations that have been suggested, before proposing a new alternative reading. The matter is of intrinsic interest to anyone who sees value in trying to get to the bottom of tricky texts about puzzling questions by great philosophers, (...) but I argue also that the investigation may help us with another vexed interpretative issue relating to an even more famous philosopher, David Hume, and that it may hold lessons for the philosophy of mind today. John Stuart Mill’s justification for British rule in India is well known. Less well known and discussed are Mill’s extensive writings on the practice of British rule in India. A close engagement with Mill’s writings on this issue shows Mill was a much more uncertain and anxious imperialist than he is often presented to be. Mill was acutely aware of the difficulties presented by the imperial context in India, he identified a number of very demanding (...) conditions that would have to be met if Britain’s imperial mission was to be successful, and he was very troubled by the dangers posed to this mission from politics in Britain. Toward the end of his life, Mill become much more pessimistic about the progressive possibilities of British colonialism, in part because of what he thought had happened after the transfer of British rule from the East India Company to the British state. A focus on Mill’s arguments about the practice of British rule in India goes some way to providing a more nuanced account of what Mill thought about colonialism. (shrink)

Peter Abelard (1079–1142 ce) was the most wide‐ranging philosopher of the twelfth century. He quickly established himself as a leading teacher of logic in and near Paris shortly after 1100. After his affair with Heloise, and his subsequent castration, Abelard became a monk, but he returned to teaching in the Paris schools until 1140, when his work was condemned by a Church Council at Sens. His logical writings were based around discussion of the “Old Logic”: Porphyry's Isagoge, aristotle'S Categories and (...) On Interpretation and boethius'S textbook on topical inference. They comprise a freestanding Dialectica (“Logic”; probably c.1116), a set of commentaries (known as the Logica [Ingredientibus], c. 1119) and a later (c. 1125) commentary on the Isagoge (Logica Nostrorum Petititoni Sociorum or Glossulae). In a work Abelard called his Theologia, issued in three main versions (between 1120 and c.1134), he attempted a logical analysis of trinitarian relations and explored the philosophical problems surrounding God's claims to omnipotence and omniscience. The Collationes (“Debates,” also known as “Dialogue between a Christian, a Philosopher and a Jew”; probably c.1130) present a rational investigation into the nature of the highest good, in which the Christian and the Philosopher (who seems to be modeled on a philosopher of pagan antiquity) are remarkably in agreement. The unfinished Scito teipsum (“Know thyself,” also known as the “Ethics”; c.1138) analyses moral action. (shrink)
